Terms of Service

1. Acceptance of terms

By accessing or using any Titans Lab website or service you confirm that you are legally capable of entering into a binding agreement and that you accept these Terms of Service. If you are using our services on behalf of a company, you represent that you are authorised to bind that company.

2. Services we provide

Titans Lab provides Synthetic Intelligence platforms and related services, including but not limited to: Cogni, Synapse, and Titans Telco. Specific services may be governed by additional agreements or order forms between you and Titans Lab.

3. Acceptable use

You agree that you will not:

• Use our services for unlawful, harmful, or fraudulent activities
• Attempt to gain unauthorised access to systems, data, or user accounts
• Reverse engineer or attempt to extract source code except where permitted by law
• Interfere with or disrupt the integrity or performance of the services
• Use our services to violate the privacy or rights of others

4. Accounts and security

Where an account is required, you are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any suspected unauthorised use or security incident.

5. Intellectual property

Titans Lab retains all intellectual property rights in and to its platforms, models, software, and documentation, except where expressly stated otherwise in a signed agreement. You receive a non-transferable, non-exclusive right to use the services as set out in these terms and any applicable commercial agreement.

6. Third-party services

Some functionality may integrate with or depend on third-party services. Those services are governed by the terms and privacy policies of the relevant third parties. Titans Lab is not responsible for such third-party services.

7. Data protection

Our handling of personal information is described in our Privacy Policy and Cookies Policy. By using our services you acknowledge that your data will be processed in accordance with those documents and applicable law, including POPIA.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including fitness for a particular purpose, non-infringement, and accuracy of outputs produced by SI systems.

9. Limitation of liability

To the maximum extent permitted by South African law, Titans Lab and its directors, employees, and affiliates will not be liable for any indirect, consequential, or special damages, or for loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of our services.

10. Suspension and termination

We may suspend or terminate access to the services where you materially breach these terms, attempt to compromise security, or use the services in a way that could cause harm to us, our customers, or third parties. Where reasonable, we will provide notice before suspension or termination.

11. Changes to the services and terms

We may improve or modify the services over time. We may also update these Terms of Service to reflect changes in our services, legal requirements, or business practices. When changes are material we will update the "Last updated" date and, where appropriate, provide additional notice.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Any disputes arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the South African courts, unless otherwise agreed in writing.
